OPINION: 801 Magnolia Ave. Use Needs Public Hearings

– Piedmont Priorities –

With life as good as it is in Piedmont, it’s hard to think how it could get better. But there’s always room for improvement so in 2007 the City conducted a community survey as a prelude to updating its General Plan.

The response to the 2007 survey exceeded all expectations. Approximately 3,800 surveys were mailed out, and almost 1,300 surveys were completed and returned. That’s a 34% response rate, the highest ever response rate of any community survey of Piedmont residents.  Question 7 in the survey asked “For which types of projects would you support increases in city taxes or fees?”.  The range of responses to that question are in the table below.

Now 14 years later, what has come of this community survey?

Additional recreation facilities – check.

City-owned pool? – check.

Backyard service for recycling/green waste – check.

City arts and cultural center – half-check.  The city has a classical arts and cultural center. Chamber music only.

A teen center – negative.

Creating a community gathering place or plaza – negative.

Why this lookback matters is because the city is on the verge of missing a golden opportunity to address the two negatives on the list.  A teen/senior center and community drop-in space could easily be run out of the East Wing of the building with access to the restrooms in the West Wing and the placing of city staff in the West Wing office space.  And no additional taxes required – seniors and the community don’t need to be supervised by staff.  They do need a place to freely gather and schedule meetings and an accessible East Wing would facilitate that.  

Instead, city staff has negotiated a lease for the 801 Magnolia Building with the Piedmont Center for the Arts that reduces both city use of and access to the 801 building for the next 7 years. So the City has two choices – hold a public hearing on the use of the 801 Magnolia building or a second reading of the flawed lease.  By all indications, city staff is proceeding with a second reading of the lease with PCA.  Unless Council steps up and calls for a public hearing, this opportunity for Piedmonters to achieve long-standing aspirations of a community space will be lost for another 7 years.   To that end, newly elected Councilwoman Conna McCarthy could honor her campaign pledge and call for public meetings on the use of 801 before any lease is approved:

“I want to be part of the leadership that encourages large conversations where all stakeholders thoughtfully plan and manage limited resources for the benefit of Piedmont now and into the future.”

First Time Piedmont Budget Advisory and Financial Planning Committee Can Be Publicly Viewed from Home or Office

Bond Measure on November 2020 Ballot ?

Community participation in setting priorities ?

The Piedmont Budget Advisory and Financial Planning Committee (BAFPC) has recently been charged by the Piedmont City Council with coming up with ways to fund Piedmont public projects. 

According to public comments, funding is possibly a bond measure for the November 3, 2020 Piedmont ballot.  The Council will need to make a decision on placing a bond measure on the November ballot no later than August. 

To date, there have been no public meetings or surveys to determine the list of desired projects which Piedmonters would favor. 

Hundreds of thousands of dollars have already been spent by the City Council on consultants and staff work proposing and planning special recreation projects.  Recreation projects have focused on a new Municipal Pool and Aquatic Center, Linda Beach Park play areas, and Coaches Field.  Other city facilities are also on a priority list. 

Very recently, 20th century Fire and Police facilities and readiness have been added to the Council list of possible projects needing funding sources. Public input has not been solicited on these projects. 

Infrastructure improvements to roadways, sidewalks, curbs and gutters and  undergrounding of overhead wires are not listed on the City Council priority list for funding.

Where is the money going to come from?

BAFPC to advise the City Council on funding sources.

For the first time, at-home citizens will be able to view and participate in the BAFPC deliberations and recommendations. Typically, the meetings have been held away from cameras with no minutes produced of the meetings.  The BAFPC Chair generally writes the Committee recommendations that are forwarded to the City Council. 

The Committee advises on tax levies, bond measures, financial planning, and budgetary matters. See items listed on the May 7, 2020 meeting agenda below.

City Council: Significant New Funding Source for Improvements to Selected City Facilities, Recreation, Police and Fire

Does COVID-19 change Piedmont’s priorities for spending?

Are Piedmonters interested in taxing themselves further for additional city expenditures?

Year after year, Piedmont taxpayers have generously approved bond measures for school facilities and parcel taxes for school and city operations.  Currently, there are no voter approved city bonds.

The Piedmont City Council’s long list of capital projects for new expenditures without sufficient funding include extensive new and revised recreation facilities, the municipal pool, playgrounds, etc.  Also on the list are improvements to City Hall, Police Department, Fire Department and other municipal facilities.  Not on the list for improvements are streets, sidewalks and undergrounding of utility wires.

Streets and Sidewalks:

During COVID-19 restrictions, many Piedmonters are walking or running on Piedmont’s streets and sidewalks to get exercise and recreate One cannot help but notice the many cracked, lifted, eroded, and dangerous sidewalks in the city.  Many streets have faulty pavement and have not been repaved in decades. Curbs and gutters on numerous streets have lacked care, thus leaving pools of water and uneven surfaces.

Most funding for Piedmont sidewalks and street resurfacing comes from outside sources.

The City of Piedmont is charged with and oversees the maintenance of the city’s streets and sidewalks.  The city owns Piedmont’s beautiful street trees and is responsible for damage caused by these trees to sidewalks and gutters. Property owners are not allowed to trim or remove street trees.  Changes by residents to sidewalks and gutters require city permits.

Street Infrastructure Maintenance & Replacement

“The City’s FY 2019-20 budget for street infrastructure maintenance and replacement is $1.4 million. Funding sources include Measure B, Measure BB, Measure F, and the Gas Tax, which also now includes funds from SB-1 that was recently approved by the state legislature. The majority of available funding is dedicated to street resurfacing and sidewalk repair work, with the balance dedicated to important sub-categories such as the implementation of projects prioritized by the approved Pedestrian & Bicycle Master Plan, and those related to the Complete Streets program.” Piedmont 2019-20 Budget

Undergrounding of Utility Wires:

Most areas in Piedmont do not utility wires placed underground, yet undergrounding of utilities has been deemed an important mechanism for providing safety during fires and earthquakes.  Undergrounding is also considered a highly desired aesthetic improvement to Piedmont.  No money is set aside in the Piedmont budget for undergrounding projects.

Currently, the Council is looking toward a city bond measure to finance either partially or totally their long list of selected improvements or changes to city facilities including the Municipal Pool, Playfields, city facilities – police, fire departments, etc.  Streets, sidewalks and underground utilities are not on the city list.

An expenditure of $50,000 to hire a consultant related to the Planning Process for Possible City Facility Renovation Projects will be undertaken at the April 20, 2020, City Council meeting.  Public outreach would be part of the process.

Crime Report Shows Improvements While Underage Drinking and Smoking Presents Concern

On November 6, 2017, I attended a City Council Meeting which addressed the third quarter reports of the Piedmont Police Department and the authorization of limited obligation bonds linked to Undergrounding Assessment Districts. New technologies utilized by the Police Department were also discussed.

The meeting began after the Council recited the pledge of allegiance, which is a custom at the beginning of every meeting. Before Chief of Police, Jeremy Bowers, was called to present his report, the City Clerk called for any persons to address a matter not present on the Agenda.

I went to the podium and discussed my gratifications towards the recent developments and improvements to Hampton Park. I expressed that the changes were a great benefit to the City and that it was nice to see brand new turf and foundations. The Council members seemed very pleased with my remarks, giving me happy nods and cheerful smiles.

After my address, the City Clerk called Roy Connors to the podium. Roy expressed his deep feelings about the benefits of constructing telephone lines throughout the area. Roy went on to say that, “I believe that the construction of these lines would greatly improve cell reception and provide reliable phone connections to areas of Piedmont.” The Council members unanimously nodded there heads in agreement and Roy stepped off the podium.

Lastly, a man approached the podium and discussed the recent implications of the disastrous Napa fires and how Piedmont residents should prepare for an event like this. He proposed to the Council the benefits that would be included with fire insurance being provided to residences. The Council agreed that further steps should be taken in order to prepare for a situation like the Napa fires.

After the clerk called for any last comments, the Chief of Police gave his address on the 3rd Quarter crime rates.  Chief Bowers began his address by stating that crime rates have dropped by 15% compared to this time last year. He cited that there were 176 reported crimes last year compared to the 146 crimes reported this year. The Council commended this statistic and he continued by saying that “Robberies have declined from 11 to only 1,” which met with even more praise. Chief Bowers attributed these downward trends to technology, officer awareness, and citizen reports.

Chief Bowers went on to explain how new technologies such as camera’s were providing the identification of wanted criminals. He described a situation which involved the brandishing of a firearm as a means of road rage. The suspect was later identified after he was reported, thanks to the use of high optic cameras installed at the intersection where the scene occurred.

After Chief Bower’s debrief on crime statistics, he delved into the topics of underage drinking and smoking. Bower’s emphasized that the Piedmont Police were not serving to punish kids, but were merely attempting to protect them from the harm that ensues from drinking and smoking. He went on to explain the repercussions of marijuana use and how the police department is cracking down on kids smoking in Piedmont Park.

Underage drinking was also briefly discussed.  Bowers stated, “Recently two girls had to be transported to a hospital for acute alcohol poisoning. The Police Force cares about the short term and long term effects of these kids’ health.” This statement prompted Council member Jen Cavenaugh to commend Chief Bowers on all he was doing to suppress the problems of underage drinking and smoking.

Once Chief Bowers had concluded his report, the City Clerk asked the Council members if they had any questions they wished to discuss. Council member Tim Rood, appreciated the recent decline of car collisions, which has decreased by 20% since last year.

Mayor Robert McBain noted the issue of car thefts stating that, “It is important that we reduce the thefts involving cars.” The Mayor suggested that people should hide any valuables in their cars. McBain concluded his remarks by re-affirming to the public that, “The Piedmont Police are here to help us and protect us.”

I believe that Chief Bowers is doing a tremendous job of reducing the criminal activity in Piedmont and also spreading awareness about the dangers of drinking and smoking. These changes will ultimately benefit Piedmont and new technologies will also contribute even more to a decrease in crime rates. Regarding Bower’s address on kids health, I believe that it was very powerful for him to say that the Piedmont Police Department truly cares for every single Piedmont Unified School District kid. The Police only seeks to enlighten us on the dangers of underage drinking and smoking and are not here to incarcerate any teenagers.

At the end of the meeting, I interviewed a local resident of Piedmont, Lisa Gros. Mrs. Gros attended the meeting with her son who was a Boy Scout, as he was required to attend a City Council meeting. She was intrigued about the topics of drinking and drug awareness and seemed optimistic that her son would never partake in such activities.

I then asked Mrs. Gros how she would take action on the issues of underage drinking and smoking to which she replied, “I will be a role model for my kid and give him the right guidance when the time is right, but for right now I just hope that being openly against underage drinking will be enough to dissuade these kids from partaking in these detrimental activities.”

The City Council meets on the 1st and 3rd Monday’s of every month to address community issues and to hear community input from local residents and officials.

I attended a Piedmont City Council meeting at the Piedmont City Hall on November 6, 2017. The main topic on the agenda at the November 6 meeting included the Police Quarterly report presented by Piedmont Police Chief Jeremy Bowers. The Police Quarterly Report dominated the majority of the meeting as recent crime reports and specific criminal incidents in general were addressed.

Bowers said that the crime rate is continuing to decrease in the past two years. Bowers also was concerned with recent incidents of mail being stolen from citizens, and suggested that citizens should shred old mail.

A big issue was the recent incidents regarding parties in Piedmont where two girls were hospitalized for alcohol poisoning. Police intend to be vigilant for parties and be on the lookout for alcohol consumption among teenagers simply in concern of their long term health.

Councilwoman Jen Cavenaugh asked Bowers if the Police Department tracks who hosts these private parties. Bowers responded by saying that the police do take note of that yet try to educate residents about the City of Piedmont ordinances regarding parties.

Another topic in the police report was the policy on marijuana use by young people. Bowers spoke of two officers from the Piedmont Police who went to Colorado to study how the legalization of marijuana has affected the state, and how it will work in California when it is legalized.  Bowers said the Police Department wants to educate young people on the effects of  marijuana use as opposed to taking a strictly punitive approach.

Councilwoman Cavenaugh asked if the police would still enforce the laws and punish young people caught with marijuana, and Bowers responded by saying that they would while emphasizing education and would also increase police controls in the Piedmont Park as that is an area where marijuana use is prevalent.

I appreciate this approach by Bowers as it is important for people to know what they are doing wrong and why it is harmful as opposed to being locked up without learning more about the crime they committed.

After the meeting concluded, I interviewed Bryan Gros, who attended the meeting with his son who is a Boy Scout and must attend a City Council meeting in order to earn his communication merit badge. Gros went there to support his son and he “learned a lot about the Piedmont Police Department.” In terms of his reaction to the police report, Gros said he “appreciated the way that the Police Chief thinks the best way to handle issues is in the community.”

At the beginning of the meeting, there was an opportunity for citizens to speak to the Council regarding any issue. I spoke about the recent protests in front of City Hall regarding the installation of new cell phone towers throughout the City. I said that the cell phone towers were necessary because the service in areas such as Hampton Field is quite bad and is inconvenient and could pose as a safety risk if someone needs to make an emergency call but cannot due to poor service. I also said that cell phone towers themselves do not cause harm to anyone and the protestors are misinformed on the effects of the towers.

The Piedmont City Council meets on the first and third Monday of each month at 7:30 p.m. The Piedmont City Council addresses issues of public safety and budget issues for the City including various aspects of the City. including the Police and Fire Departments.

Opinion: Prior Cell Tower Discussions by City Council

Report: Cell Towers, High School Parking, Bond Reissuance –

On October 2nd, 2017, a City Council meeting was held in the Piedmont Council Chambers. After the pledge of allegiance the council held a moment of silence for the victims of the Las Vegas massacre. The council then started going through the Consent Calendar, in which the Mayor removed himself from voting on item 6 [concerning private undergrounding bonds: Consideration of Direction to Staff Regarding the Possible Refinancing of the Bonds of the Dudley, Mountain, and Blair Avenues Underground Assessment District; the Wildwood and
Crocker Avenues Underground Assessment District; and the Piedmont Hills Underground Assessment District] because he was a resident of the neighborhood impacted by the bonds.

The next item on the agenda was the Public Form where a couple of stunning young lads, Lane Bentley [author] and Julian Turner, got up to talk about the incredibly painful parking issue that occurs around the high school campus. They suggested that we open the Community Center parking lot which is near the Main Park for parking all day during school hours.

Once they finished the Public Forum, the Council moved on to the main topic of discussion which was the proposed cell phone tower plan by Crown Castle. There are many sites proposed lying throughout Piedmont mostly in residential areas and parks on top of telephone polls.

Kevin Jackson, Planning Director,  stated facts about the Crown Castle communications debate on the telecommunications issue.

The next person to speak was Pierce MacDonald-Powell of the City Planning Department, who noted all the sites of the cellular towers and stated additional facts addressing the issue. After which, two representatives of Crown Castle got up and spoke on behalf of the company. They said that the towers were not breaking any rules or safety regulations and that Crown Castle has worked with the city of Piedmont in order to try to reach a compromise.

After the two Crown Castle members spoke it was time for the public to speak. Every single person to get up and speak address the council pleaded there disinterest in the towers due to variety of things. One of those was aesthetics, almost mentioned the damage to the aesthetics of Piedmont.

A more serious issue with the cell phone towers that was brought up was health concern. One man was stating that one of the towers was no more than 10 feet from a family’s balcony. Another speaker mentioned how the FCC safety regulation regarding the radius of radiation was inaccurate because the “safe” frequencies have caused harm.

A couple of speakers mentioned a medical condition that these towers cause where the electromagnetic fields from the towers cause pulsation and pain within a person’s head. Their argument was that since the government is requiring these cell towers, they cannot cause harm on the people of the state because that would go directly against protection laws.

Another man living near Witter Field said that the plates they were going to use for the sidewalk next to the cell phone tower would cause noise pollution and ruin the peace for those living near Witter Field.

Unfortunately, I had to leave in the middle of the public hearing, but on my way out I interview a young boy who was at the meeting, his name is JD. He told me that he was there for the Boy Scout merit badge – Citizenship in the Community. He didn’t have much else to say as far as his concerns and issues that he wants changed, but he did state that his view of the issue changed.

When I asked JD about his thoughts on the meeting, he told me that he really didn’t have any prior knowledge of the meeting, but he did say, “At first I thought that the cell phone towers were all beneficial, but then I learned about all the potential health effects that come with them.” JD was also surprised about the amount of people that were so strongly opposed to the towers. JD is still working on his merit badge and becoming an Eagle Scout and hopes that there are no cell phone towers outside his house.

A City Council meeting happens about twice a month and the City Council members consider actions and take input from the residents of Piedmont about certain problems and issues affecting our community.

Hampton Field: Special Tour and Meeting, Friday, July 29

City Council will tour Hampton Field Renovation Project and Review Project Progress (No Action Will Be Taken).

“The $2 million project was approved by the City Council in late April. The large-scale improvements are being financed by a combination of public and private funds. The city is using $507,000 in Measure WW park bond money, $417,000 from the legal settlement with Harris & Associates over the Piedmont Hills undergrounding project and about $390,000 in private donations. The city is backfilling the remaining cost for now from the athletic facilities preservation fund and the general fund. OPINION: Reject Measure F Now, Put Two Measures on the November Ballot

Piedmont’s taxpayers have paid over $2 Million in excessive costs for City projects due to poor management ($1.3 M from the Undergrounding fiasco, $400,000 from Blair Park’s so-called “gift,” $340,000 from purchasing police radios that are incompatible with Alameda County).

While the City has some new senior-level employees, the consequence of past incompetence requires greater disclosure and transparency to re-establish taxpayer confidence that Measure F’s increase in taxation is really necessary.  Measure F asks for a 30% tax increase without specifying what exactly would be done, while  underestimating property tax revenues in spite of a 25-year trend of increasing revenue.

Approval from two-thirds of the electorate should require two ballot measures, one to maintain service at the current tax rate, and another to increase service with specific projects at an increased tax rate.

If Piedmont voters reject Measure F now, the pair of measures could be placed on the November ballot without danger of current services being interrupted, because the existing tax doesn’t expire until June, 2017.

Hampton Field: City Finds $1,471,435 to Complete Project

The entire Hampton Field project will move forward, if the Council approves Hampton Park Improvements Budget of $1,978,760.

City Administrator Paul Benoit in his April 18, 2016 staff report asks the City Council to approve a budget of $1,978,760 for Hampton Park Improvements and authorize him to sign a construction contract in the amount $1,573,435.50 with low bidder Suarez and Munoz to complete the plan for the park. The City Council approved the Hampton Park Improvements Master Plan on June 2, 2008. The project was then sidelined due to budgetary constraints. On March 3, 2014, the Council awarded a $134,238 contract to William Harris, Harris Design for plans for phasing the project or, alternatively, completing the entire project at one time. The focus has been on refurbishment of the hardscape surfaces for tennis, basketball and handball as well as drainage improvements (Phase I).  Hazardous conditions on the tennis courts, significant maintenance of the play field during and following wet weather, soil wash out onto nearby roadways, and other issues have been a concern. Measure WW, East Bay Regional Park District (EBRPD) Local Grant Funds, in the amount $507,325 were previously approved for the project. To complete the entire project, Phase I and II, the estimated cost is $1,978,761. The City will add $1,471,435 using various pots of City money and donations.

CIP Committee Seeks Resident Proposals and Participation

Deadline for proposals: March. 25th – 5:00 p.m. City Hall

The Capital Improvement Projects Review Committee (CIP) is soliciting proposals for new city projects which would enhance our community. Ideas submitted by individuals, community organizations and City Staff are all considered. If you have a great idea, the committee would like to hear from you. Projects can range from sidewalk improvements to plantings to facility renovations or additions to undergrounding of utilities to parks.

All applicants/residents that have submitted proposals will be personally invited to attend the CIP Meeting to be scheduled in April. The meeting is open to the public.  This meeting will not be broadcast nor recorded. At this meeting, applicants will be asked to briefly describe their projects to the CIP Committee. The CIP Committee will then determine which projects will require a site visit.

The CIP Site Visit Tour will be scheduled for a Saturday in April. The tour will commence at City Hall at 9:00 am and then will proceed to CIP tour stops located throughout the City. At each of the tour stops, the CIP Committee will see the locations for proposed projects first hand.

At the undetermined date, a noon working lunch will be provided at City Hall for Committee members, city staff, and interested citizens.

At this working lunch the CIP Review Committee will attempt to compose their list of 2016-2017 CIP projects that they recommend as a part of this year’s budget process. The CIP chair in conjunction with CIP Review Committee members will be asked to prepare a list of recommended projects and narrative that will be forwarded to the City Council for consideration in the budget process.
